2. BASIC PROVISONS

2.1. Issues not regulated in the current Articles and the interpretation of these Articles are governed by Hungarian law, with particular regard to the provisions of Act V of 2013 of the Hungarian Civil Code (“Civil Code”) on certain aspects of electronic commerce services and information society services from the 2001 Act CVIII (E-commerce law) and the detailed regulations on consumer-business contracts of Government Decree 45/2014. (II. 26.). The mandatory provisions of the relevant legislation shall apply to the Parties, without any special clause.

2.2.    These Articles are effective law since 13.08.2023. and remain in force until revocation. The Service Provider has the right to unilaterally amend the Articles (circumstances that may lead to change: change in shipping cost, change in legislation, business interest, changes in company). The modifications need to be issued 11 (eleven) days before the effective date by the Service Provider on their website – during which time the User is entitled to rescind or terminate the contract. By using this website, the User agrees that all regulations governing the use of this website are automatically applicable to them.

2.3. The Service Provider reserves all rights in connection with the content and dissemination of the website and webpages.  It is absolutely forbidden to download, store (electronically), process, or sell any content published in the website or any aspect of the content without the written consent of the Service Provider.

3. REGISTRATION, PURCHASE

3.1. The User is obliged to provide his/her real data at the time of purchase/registration. In the event of false or personally identifiable information provided during purchase/registration, the resulting electronic contract will be considered void. The Service Provider disclaims any liability if the User makes use of its services on behalf of another person with the data of another person.

3.2. The Service Provider shall not be liable for delivery delays or other problems or errors due to incorrect and/or inaccurate data provided by the User.

3.3. The Service Provider shall not be liable for any damages resulting from the User’s forgetting his/her password or the access of unauthorized persons for any reason not attributable to the Service Provider (if registered on the site).

4. AVAILABLE SERVICES

4.1. Displayed services can only be ordered online. The prices displayed for the services are in EUR and include the statutory VAT. However, they do not include home delivery charges. No separate packaging costs will be charged.

4.2. In the web shop, the Service Provider details the name, description of the services.

4.3. If there is a service on sale, the Service Provider should inform the User about the sale and its exact duration.

4.4. If the wrong price is displayed on the website – despite the due diligence of the Service Provider – and the price is obviously incorrect, the Service Provider is not required to confirm the service at the wrong price, especially if there is a significant difference. For example, if the price is set at EUR 0 or EUR 0.01 because of a system error, then the Service Provider shall not be obliged to deliver the service at the incorrect price, but may offer the delivery at the correct price, in the knowledge of which the Customer may refuse to make the purchase. In accordance with the case law of the Hungarian judiciary, a significant difference is generally considered to be a deviation of at least 50% in a positive or negative direction from the market value of the given service. However, consumers are informed that the concept of striking value imbalance (Section 6:98 of the Civil Code) is not precisely defined by law.

4.5. In the case of a defective price as described in Section 4.4, there will be a noticeable mismatch between the true and the indicated price of the service that the average consumer will immediately notice. Pursuant to Act V of the Civil Code of 2013 (Civil Code), the contract shall be created by the mutual and unanimous expression of the will of the parties. If the parties are unable to agree on the terms of the contract, i.e. there is no mutually agreed statement on the will of the parties, it is not possible to speak of a valid contract that would give rise to rights and obligations. On this basis, an order that has been confirmed at the wrong/erroneous price is considered to be null and void.

5. SERVICES

The services provided comes with costs of operation that includes energy and human resources. The service provider calculated a minimum hour rate based on these costs. All service prices are based on working hours or so called studio time therefore the subject of sale is working hours. Working hours grouped into packages based on common audio tasks and consultation topics. The packages are named to represent and describe a specified task so that could be presented as avaliable services for the customers. The customer is buying predetermined amount of working hours for the described tasks/consultation with the purchase of a service. The service provider will state consultation on invoices because by processing the submitted media the service provider doesn’t do creative content creation only suggets modifications by presenting solutions for the customer therefore not gaining copyright or cowriter rights. The only exclusions from this method are the services that include melodic and pattern modification/creation tasks, in which case the customer accepts that cowriter rights are granted for the service provider and agree to pay 10% of the whole revenue from that music and is paid yearly .

5.1. Customer

One person or one producer team. Must be 18 years or older. Maximum number of individuals in a producer team is four members. This restriction is also refers to companies that may share the services with members. The goal of this rule is prevent unathorised publication of our intellectual property.

Any person or company considered to become a customer when sucessfully paid for a service. This rule is to prevent bots or potentional frauds taking time and energy from the customer service. Any problem may occur with payment can be solved once service provider verified a real interest. In order to validate a real request the customer service starts communication and may ask for additional information such as profiles on social media and other proof that the interest is harmless. In case of fraud or spam activities the customer service blocks further communication and takes preventive IT actions for protecting the intellectual property. Scam and financial frauds will be forwarded to have legal actions taken by the monitoring team.

Customer acknowledges that filling in the form sent by the service provider and submitting the material for processing is mandatory, as the material is an essential basis for the service, which can be parameterized with the help of the submitting form. In case of failure to do so, the service cannot be provided for reasons clearly attributable to the customer, in which case the service provider is entitled to retain the full purchase price. This restriction is necessary to avoid money laundering. At the time of purchasing the service, the content does not have to be immediately available and ready to be sent, it is enough to send it later as the booking system allows the customer to choose a later date when the material will be ready. It is essential to submit material for the performance of the service, therefore if the customer does not comply with this, it is clearly a fault that makes it impossible to have served and can only be blamed on the customer, in which case the customer is not entitled to a refund.

The customer reserves an appointment for a specific service, at which time he guarantees that he will submit the necessary materials in the appropriate format and in accordance with the technical requirements. Booking an appointment and submitting the material are interdependent processes. In the event that the material is not ready yet, but the customer already knows the preparation date, We provide the option to delay the submission of the material, the latest date of which is 1 day before the scheduled date. Customer can do this by indicating in writing when booking the appointment that the material is not ready yet, and will send it later. If customer does not comply with this by the given deadline, the appointment will be rescheduled for a later date. If changes are needed, there is no need to make a separate appointment for revisions as the service provider will handle it within its own authority in order to be able to complete it as soon as possible. In the event of not finding an available date in the booking system, customer will not be able to submit the material either, in such a situation, it is required to contact the customer service, which can be reached through the contact menu from the webpage. This situation can occur if all the dates of the studio have been booked or the services are temporarily unavailable due to illness, vacation, or technical problems. Furthermore, it is important to draw attention to the fact that this is error message could also be present if the invitation is only opened on a date that is already after the interval(s) of the given date options. Usually this happens if the customer doesn’t opens the invitation mail for several days or weeks, or if the studio runs on a very busy schedule and other customers may have taken up the offered date options. This could be solved by contacting the customer service to generate another invitation.

The customer accepts the format restrictions defined by the service provider and adheres to them. Customer acknowledges that the quality and nature of the submitted material strongly influences and can limit the final result of the service. The service provider is not obliged to accept submitted material that does not meet the formal requirements, as their processing may lead to additional work. In such a case, the service provider may apply surcharge for the extra work if decides to accept the material for processing.

5.2. YOUR MEMBERSHIP ACCOUNT

If you are under 18, you may use our website only with involvement of a parent or guardian. Slide Mastering and its associates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.

5.3. REVIEWS, COMMENTS, EMAILS, AND OTHER CONTENT

Visitors may post reviews, comments, and other content: and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of “spam.” You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. If you do post content or submit material, and unless we indicate otherwise, you grant Slide Mastering and its associates a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish.

5.4. Refund Policy

The service provider reserves the right to cancel any order, in this case an instant refund is initiated for the customer. Causes of cancellation could be overbooked studios, vacation, technical issues, sick leave. If the customer issues a refund for example accidentaly choose the wrong service or added too many in the basket, a processing fee may be deducted from the refunding amount, that covers the administration and banking costs. If such mistake is happened customer must send the refund claim before boooking process.

The service provider excludes the option for refunds based on unsatisfied customer opinion as the artistic nature of the topic is subjective and therefore cannot be judged objectively. This would leave opportunity for unethical behavior that could affect the profitability of the business in a negative way. Only technical terms can be measured this is why the submitting form provided for the customer includes some technical questions, but there is still a possibility to ask for unrealistic or impossible results, as the outcome of the process is based on the material/media that the customer provides and therefore the service provider has no controll over it. For a fair and etchical policy revisions are provided free of charge to ensure the best results. Still this isn’t guarantees that the customer requirements are met, yet proves that the service provider does it’s best to fulfill the customer demands.

In order to prevent money laundering, refunds may be not eligible in cases where the client does not send media/material for processing and/or not using the chosen services by avoiding booking and submitting procedures so that it delays the claim for refund.

In order of defence against potentional unethical behavior all sales are final sales because once the processed media or presentation is delivered to the customer the service provider can no longer take it back as it is an intellectual product/service therefore there is no option to be sure that the finished work won’t be used by the customer.

5.5. Payment

All services offered are working as either a onetime advance payment or in a prepaid monthly subscription model. Payments can be done by bank card or by bank transfer. Companies that would like to use their VAT ID to purchase in net prices must ask for a proforma invoice and make payment by bank transfer.

For contacting us use the contact form located in the menu.

6. ORDER PROCESSING AND FULFILMENT

6.1. Orders are processed during opening hours. In addition to the times specified for processing the order, it is possible to place the order after the end of the working day and it will then be processed the next day. The Service Provider’s customer service will always confirm by electronic means when the order can be fulfilled.

6.2.    The general deadline for delivery is within 30 days of payment

6.3. According to the contract of sale, the Service Provider shall transfer the ownership of the product and the User shall pay the purchase price and receive the product.

6.4. If the seller is an enterprise and the buyer is a consumer and the seller undertakes to deliver the item to the buyer, the risk of damage passes to the buyer when the buyer or designated third party takes possession of it. The risk of loss shall pass to the buyer upon purchase if the courier has been instructed by the buyer, unless the courier is recommended by the seller.

6.5. If the seller is an enterprise, and the buyer is a consumer, for lack of a distinct agreement of the signatories, the seller (based on this GTC: Service Provider) is obligated to make available the product for the buyer (User), after the conclusion of the contract, but in no more than 30 days.

6.6. If the product is not provided in time by the Service Provider, the User has the right to set a deadline for a replacement. If the seller fails to perform within the grace period, the buyer is entitled to cancel the contract.

a) the Service Provider has refused to perform the contract; or

b) the contract should have been performed in accordance with the agreement of the parties or due to the recognizable purpose of the service, within a specified period of time and not otherwise.
